Clause 1
PARTIES, JOB INFORMATION & CONTRACT DOCUMENTS
FleetGo Moving Services is operated by FleetGo Logistics Inc. Throughout this Agreement, “FleetGo,” “Company,” “we,” “us,” and “our” mean FleetGo Logistics Inc., operating as FleetGo Moving Services. “Customer” means the person accepting or authorizing the services. The written quotation or estimate, booking confirmation, disclosed inventory, approved written changes, this Agreement, and any signed risk authorization or job note form the service contract. The Customer must provide accurate addresses, inventory, stairs, elevators, parking restrictions, long carries, heavy or oversized items, access restrictions, and other material job information.
Clause 2
SCHEDULED ARRIVAL, ACTUAL ARRIVAL & BILLABLE START
A scheduled arrival time or arrival window is an anticipated service time and is not a guarantee of arrival at an exact minute. Traffic, road conditions, weather, delays arising from an earlier move, building restrictions, emergencies, vehicle or equipment issues, and other operational circumstances may reasonably affect arrival. Hourly labour billing does not begin merely because the scheduled arrival time has passed. The Customer is not charged labour for time before the crew actually arrives at the pickup location. After arrival, the Customer will be given a reasonable opportunity to review and sign this Agreement and confirm job information. Ordinary contract-reading and signing time before the recorded start of work is not billable moving time. After acceptance, the Actual Billable Start Time will be recorded. Labour billing begins from that recorded time. A reasonable arrival delay does not automatically entitle the Customer to a discount, refund, rate reduction, waiver of a service fee, or reduction of the minimum charge. Any discount, credit, goodwill adjustment, or pricing exception is valid only when expressly authorized by an authorized FleetGo representative.
Clause 3
THREE-HOUR MINIMUM, HOURLY PRICING & TIME ROUNDING
Every move is subject to a minimum three (3) hour labour charge unless FleetGo expressly agrees otherwise in writing. The applicable service fee, approved additional charges, materials, parking, tolls, heavy-item charges, and HST or other applicable taxes are additional where stated in the quotation or lawfully authorized. For hourly moves, the Customer pays for actual billable time required to perform the services, subject to the three-hour minimum and the rounding rule below. FleetGo applies a ten-minute grace period after each full-hour or half-hour billing point. Time exceeding a billing point by ten (10) minutes or less is not automatically advanced to the next half-hour. Once the additional time exceeds ten minutes, time is rounded up to the next 30-minute increment. Examples: 4:00–4:10 is billed as 4.0 hours; 4:11–4:30 as 4.5 hours; 4:31–4:40 as 4.5 hours; and 4:41–5:00 as 5.0 hours.
Clause 4
ESTIMATES ARE NOT FIXED HOURS OR FIXED PRICES
All estimates are provided in good faith from information supplied by the Customer. An estimated number of hours is for planning purposes and is not a guaranteed maximum, fixed duration, or fixed-price commitment unless FleetGo expressly identifies the move in writing as fixed price. If a move is estimated at approximately three hours but requires four, five, or more billable hours, actual billable time is charged at the contracted hourly rate, subject to applicable law, the minimum charge, the billing rule in this Agreement, and any authorization required by law. Actual duration may vary because of inventory volume, additional or undisclosed items, stairs, elevators, long carries, parking, traffic, building restrictions, disassembly/reassembly, packing, heavy or oversized items, Customer readiness, waiting time, access, weather, and other job conditions.
Clause 5
BOOKING DEPOSIT, CANCELLATION, RESCHEDULING & DISPATCH
A non-refundable booking deposit of $100 is required to reserve the moving date, crew, vehicle, and operational capacity unless the quotation states another amount. Once paid and the booking is accepted, the deposit is non-refundable upon Customer cancellation, including cancellation shortly after payment, subject to any non-waivable legal right. FleetGo may authorize a refund, credit, transfer, or exception in writing at its discretion. Customers must provide at least forty-eight (48) hours’ notice to cancel or reschedule. Deposits may be transferred to another date only at FleetGo’s discretion and subject to availability. If cancellation, rescheduling, no-show, refusal of service, or inability to provide access occurs after dispatch, FleetGo may charge the three-hour minimum labour charge, disclosed service fee, applicable operational charges, and taxes to the extent permitted by law.
Clause 6
PAYMENT AT APPROXIMATELY 70% COMPLETION
Once approximately seventy percent (70%) of the contracted moving services have been completed, FleetGo may require payment of the amount then properly due before continuing the remaining unloading, placement, reassembly, or other services. FleetGo may temporarily pause further performance for a reasonable period while payment is requested, transmitted, verified, or processed, to the extent permitted by applicable law. FleetGo will not use possession of Customer goods to demand an amount not authorized by the Agreement or applicable law. Nothing in this Agreement creates an automatic lien, seizure, detention, sale, or disposal right except where such a right independently exists under applicable law.
Clause 7
NON-PAYMENT, FAILED PAYMENT, COLLECTION & COURT REMEDIES
All properly due amounts must be paid in accordance with the Agreement. A declined card, reversed transfer, stopped payment, returned payment, chargeback not supported by a valid legal basis, or other failed payment does not extinguish the underlying lawful debt. FleetGo may issue invoices, statements, reminders, and written demands for an unpaid balance and may preserve the signed Agreement, quotation, invoices, photographs, job records, time records, emails, text messages, payment records, and other relevant evidence. If a lawful balance remains unpaid, FleetGo may pursue direct collection, refer the account to a properly registered collection agency where appropriate, commence a claim in Ontario Small Claims Court where the claim falls within that court’s monetary jurisdiction, or use another court or lawful dispute-resolution process having jurisdiction. FleetGo may seek court-awarded filing fees, service costs, recoverable legal costs, lawful pre-judgment or post-judgment interest, and other amounts a court or applicable law permits. No amount is automatically recoverable merely because it is demanded. A damage allegation does not by itself cancel the Customer’s obligation to pay an undisputed lawful balance. Damage claims and payment obligations may be investigated and resolved separately, subject to applicable law. Police, emergency services, building security, or other authorities may be contacted where there is a safety concern, threat, violence, obstruction, suspected unlawful conduct, or another situation reasonably requiring their assistance. Police attendance is not represented as a method for determining or enforcing an ordinary civil debt.
Clause 8
CREW CONTROL, SAFE WORK METHODS & CUSTOMER NON-INTERFERENCE
FleetGo controls staffing, lifting technique, safe pace, equipment selection, load sequencing, number of workers assigned to an item, and other work methods. The Customer may identify what is to be moved and where it should be placed but may not require unsafe speed, unsafe lifting, overloading, or a method the Crew Leader considers unsafe. FleetGo may refuse, pause, or discontinue a task presenting an unreasonable risk of injury, property damage, equipment damage, insufficient clearance, excessive weight, hazardous conditions, abuse, missing equipment, or insufficient personnel.
Clause 9
ADDITIONAL MOVERS, VEHICLES, TRUCKS & EQUIPMENT
If FleetGo reasonably determines that additional movers, another vehicle or truck, specialty equipment, lifting equipment, protective materials, or other resources are required because of inventory, weight, access, safety, building requirements, or conditions that were not included in the original scope, additional charges may apply when disclosed and accepted as required by applicable law. FleetGo may refuse to continue an unsafe task until appropriate personnel, vehicles, or equipment are available.
Clause 10
HEAVY ITEMS & SPECIAL HANDLING
An item weighing more than 100 lb may be treated as a heavy item. Unless expressly included in the written quotation or package, the standard heavy-item charge is $100 per qualifying item. FleetGo may assess the item’s approximate weight, dimensions, construction, handling difficulty, stairs, access, and required personnel or equipment. Heavy or specialty items may require additional movers, equipment, disassembly, alternate handling methods, or refusal of the task where reasonably necessary for safety.
Clause 11
STAIRS, NARROW HALLWAYS, RESTRICTED ACCESS & OVERSIZED ITEMS
FleetGo does not guarantee that furniture or other items will fit through hallways, elevators, staircases, doorways, low ceilings, tight corners, narrow spaces, or other restricted-access areas. Where an oversized, bulky, unusually shaped, fragile, weak, or difficult item must be moved through a confined area, contact with walls, trim, doors, floors, railings, ceilings, or the item itself may be foreseeable even when reasonable care is exercised. FleetGo will identify material risks when reasonably apparent. If FleetGo recommends that an item not be moved through a particular route but the Customer instructs FleetGo to proceed, FleetGo may require a written or initialled High-Risk Move Authorization. To the fullest extent permitted by law, the Customer accepts the increased foreseeable risk of scratches, scuffs, dents, chips, finish damage, wall marks, or item damage arising from the identified clearance or access restriction, except to the extent caused by negligence that cannot lawfully be excluded.
Clause 12
PROTECTIVE PACKING & WHEN PROTECTION IS APPLIED
FleetGo may use moving blankets, shrink wrap, straps, padding, mattress bags, and other protective materials as reasonably appropriate. Protective materials are not guaranteed to eliminate all risk. The Crew Leader determines when and where protective materials can safely be applied. Certain items cannot safely be fully wrapped before initial movement, particularly on stairs or in confined spaces where blankets or shrink wrap could reduce grip, cover handholds, increase dimensions, or create a slipping hazard. Protection may therefore be applied before handling, after an item is brought downstairs, outside the property, at the vehicle, inside the vehicle, or at another stage the crew reasonably considers safer. Once FleetGo elects to wrap or protect an item as part of its work, FleetGo remains responsible for exercising reasonable care in applying and using those materials.
Clause 13
CUSTOMER DECLINES PROTECTION OR RECOMMENDED PROCEDURES
If the Customer declines or instructs FleetGo to omit a recommended protective measure, disassembly, wrapping, padding, mattress bag, or other procedure to save time or cost, FleetGo may document the instruction by initials, text, photograph, video, or risk authorization. The Customer accepts the foreseeable increased risk resulting from that specific instruction to the fullest extent permitted by law.
Clause 14
WEAK, PRE-DAMAGED, MDF, PARTICLE-BOARD & FLAT-PACK FURNITURE
Particle board, MDF, laminate, veneer, engineered wood, flat-pack or IKEA-style furniture, previously assembled furniture, aged furniture, repaired furniture, or furniture weakened through normal use may loosen, crack, flex, separate, collapse, or sustain cosmetic or structural damage during ordinary moving or disassembly/reassembly. FleetGo may advise the Customer that an item appears weak, unstable, pre-damaged, improperly assembled, or otherwise high risk. FleetGo may refuse the item. If the Customer instructs FleetGo to move it despite the identified risk, the Customer may be required to sign or initial a High-Risk Move Authorization and accepts the increased foreseeable risk associated with the identified condition, subject to non-waivable legal rights. FleetGo is not responsible for pre-existing scratches, dents, chips, loose joints, worn finishes, hidden defects, structural weaknesses, previous repairs, or other existing damage except where FleetGo independently causes additional damage through proven negligence.
Clause 15
FURNITURE DISASSEMBLY, REASSEMBLY & HARDWARE
Basic furniture disassembly and reassembly is included where reasonably required and within the booked scope. Specialty furniture or unusually time-consuming work may require additional charges when disclosed. FleetGo may refuse to disassemble or reassemble unstable, damaged, glued, stripped, corroded, modified, improperly assembled, or unsafe furniture. FleetGo will use reasonable care with hardware but is not responsible for pre-existing, worn, stripped, rusted, missing, mismatched, or concealed hardware except where loss or damage is caused by FleetGo’s negligence.
Clause 16
TRUCK LOADING, STACKING & SECUREMENT
FleetGo determines safe loading order, stacking, placement, weight distribution, strapping, and securement inside the vehicle. The Customer may not require a loading method that the crew reasonably considers unsafe or likely to damage property, belongings, equipment, or the vehicle.
Clause 17
TVs, MONITORS, COMPUTERS & ELECTRONICS
Original manufacturer packaging is strongly recommended for televisions, monitors, computers, and electronic screens. Electronics transported without original packaging or suitable protection carry increased risk. FleetGo does not guarantee the internal condition or continued operation of electronics and is not responsible for concealed internal malfunction, data loss, or pre-existing internal damage unless caused by FleetGo’s proven negligence. Customers are responsible for backing up important data.
Clause 18
CUSTOMER-PACKED BOXES, FRAGILE & HIGH-VALUE ITEMS
FleetGo is not responsible for the condition of contents concealed inside boxes, containers, bags, or packages packed and sealed by the Customer, except to the extent external handling by FleetGo is proven to have caused the loss or damage. Marble, granite, glass, mirrors, artwork, antiques, collectibles, and unusually fragile or high-value items must be disclosed before the move. FleetGo may require professional packing, crating, special handling, additional terms, or may refuse an item.
Clause 19
FOOD, LIQUIDS, PERISHABLES & TEMPERATURE-SENSITIVE GOODS
FleetGo does not provide refrigerated, frozen, climate-controlled, or temperature-controlled transportation unless expressly agreed in writing. Food, frozen goods, refrigerated items, plants, liquids, and other perishable or temperature-sensitive goods are transported at the Customer’s risk as to spoilage, melting, freezing, leakage, temperature variation, odour, or deterioration not caused by FleetGo’s negligence. The Customer must properly close, seal, and package all liquids and food products. FleetGo may refuse leaking, open, improperly packaged, contaminated, or unsafe goods. The Customer is responsible for removing or separately transporting items requiring continuous refrigeration or special environmental conditions.
Clause 20
PROHIBITED, ILLEGAL, DANGEROUS & UNDISCLOSED GOODS
The Customer represents that the shipment does not contain illegal goods, contraband, explosives, unlawfully transported weapons or ammunition, hazardous chemicals, flammable fuels, dangerous substances, unlawful drugs, stolen property, or other goods that cannot lawfully or safely be transported as ordinary household goods. The Customer must disclose potentially dangerous or regulated items before loading. FleetGo may refuse any item it reasonably believes is unlawful, dangerous, contaminated, hazardous, or unsuitable for ordinary moving transportation.
Clause 21
ELEVATORS, PARKING, BUILDING ACCESS & CUSTOMER RESPONSIBILITIES
The Customer is responsible for accurate inventory information, lawful access, parking arrangements and permits, elevator reservations, building permissions, loading-dock arrangements, safe pathways, and disconnecting appliances unless otherwise arranged. Waiting time caused by unavailable elevators, missing building access, Customer readiness, parking problems, security requirements, or other Customer-controlled conditions is billable where permitted by the quotation and applicable law. Parking tickets or fines resulting directly from Customer instructions or unavailable lawful parking may be charged to the Customer where legally permissible and properly disclosed.
Clause 22
DELAYS, TRAFFIC, WEATHER, VEHICLE/EQUIPMENT FAILURE & FORCE MAJEURE
FleetGo is not responsible for reasonable delays caused by traffic, weather, elevator issues, building restrictions, Customer readiness, third parties, road closures, accidents, vehicle or equipment failures beyond reasonable control, public emergencies, power outages, labour disruptions, natural disasters, government actions, or other circumstances beyond FleetGo’s reasonable control. FleetGo may modify procedures, pause work, change scheduling, substitute an appropriate vehicle or equipment, or reschedule where reasonably necessary to protect people, equipment, and belongings.
Clause 23
OVERNIGHT VEHICLE HOLDING & DELAYED DELIVERY
FleetGo is a moving service and does not represent that its moving vehicles are commercial self-storage facilities. At the Customer’s request, or as part of an agreed multi-day or long-distance move, goods may remain loaded in a FleetGo vehicle overnight or between pickup and delivery. FleetGo will exercise reasonable care to secure the vehicle and shipment, but a moving vehicle does not provide the same environmental controls, security systems, fire protection, or climate control as a dedicated storage facility. To the fullest extent permitted by law, FleetGo is not liable for loss or damage resulting solely from risks inherent in Customer-requested overnight or delayed vehicle holding, including ordinary temperature or humidity variation, vibration, or load settling, except where caused by FleetGo’s negligence or breach of a legal duty. No representation is made that every loss qualifies as an insured or compensable claim. FleetGo may assist in arranging third-party storage but does not itself provide warehousing merely because goods temporarily remain in a moving vehicle. Additional overnight, parking, security, mileage, waiting, or operational charges may apply when disclosed and accepted.
Clause 24
LONG-DISTANCE & SPECIALTY MOVES
For moves exceeding 150 kilometres from the pickup location, cross-border moves, storage-related moves, or specialty services, additional terms may apply, including additional deposits, travel charges, fuel, accommodation, overnight charges, alternate scheduling, delayed delivery, specialty equipment, or a separate quotation or service agreement.
Clause 25
CLAIMS, DAMAGE REPORTING & INVESTIGATION
Visible damage or concerns should be reported to the Crew Leader before departure whenever reasonably possible. The Customer should submit a written claim with photographs, proof of loss, and Job ID within 48 hours of move completion so FleetGo can investigate promptly. Failure to report promptly may affect FleetGo’s ability to investigate, but no contractual reporting period extinguishes a statutory or other legal right that cannot lawfully be shortened. FleetGo is responsible for loss or damage to the extent caused by proven negligence or other legal liability, subject to lawful limitations, exclusions, evidence, and applicable insurance terms.
Clause 26
PRICE MATCH, DISCOUNTS & NO UNAUTHORIZED PRICE CHANGES
FleetGo may consider a price match for a genuinely comparable written quote from a professional moving company. Comparability may include crew size, vehicle, insurance, equipment, scope, date, access conditions, and service level. FleetGo may decline a request that is not genuinely comparable. At FleetGo’s discretion, an eligible quote may be matched and may receive an additional discount of up to 10%. No discount, refund, credit, goodwill adjustment, waiver, or pricing exception applies unless authorized by an authorized FleetGo representative. On-site crew members cannot alter pricing unless specifically authorized.
Clause 27
CUSTOMER CONDUCT & RIGHT TO SUSPEND OR TERMINATE
Customers and persons at the premises must not threaten, harass, abuse, obstruct, or create unsafe conditions for the crew. FleetGo may pause or terminate services where conduct or site conditions create a reasonable safety or operational risk. Charges for work already performed and other lawful charges remain payable.
Clause 28
GOVERNING LAW, CONSUMER RIGHTS & SEVERABILITY
This Agreement is governed by the laws of Ontario and applicable federal law. Nothing in this Agreement waives or limits a right or remedy that cannot legally be waived or limited, including applicable consumer-protection rights. If a provision is found invalid or unenforceable, it will be interpreted or severed to the minimum extent necessary, and the remaining provisions continue in effect.
Clause 29
ENTIRE AGREEMENT, SIGNED ACCEPTANCE & RECORDS
The Customer’s signature on this Agreement is the primary on-site evidence of acceptance. FleetGo does not rely on recorded telephone calls as the Customer’s signature. Written booking confirmations, quotations, deposits, signed risk authorizations, emails, text messages, invoices, photographs, time records, and other legally admissible records may supplement the signed Agreement. No oral statement changes the written price or terms unless an authorized FleetGo representative confirms the change in writing.
Clause 30
SMS & TEXT MESSAGING CONSENT
If the Customer voluntarily selects the SMS consent checkbox on FleetGo's website, the Customer authorizes FleetGo Moving Services to send transactional text messages about the Customer's moving quote, booking, scheduling, service updates, and related customer-care communications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. SMS consent is optional, is not a condition of receiving a quote or purchasing services, and does not authorize unrelated marketing messages. FleetGo may retain consent and messaging records as reasonably necessary for compliance and customer service. Delivery of any text message is subject to carrier and network availability.
